CPS upholds its decision not to bring further charges — a final decision

The Crown Prosecution Service confirms that its January 2026 decision not to bring further charges has been upheld on review. Families of six of the nine babies covered by that decision had asked for it to be reconsidered under the Victims' Right to Review scheme. A prosecutor independent of the original decisions re-examined the evidence and reconsidered six offences of attempted murder, and upheld the original decision. Malcolm McHaffie, Head of the CPS Special Crime Division, said the Service had written to the families involved and would offer meetings. The CPS states that this represents a final decision.
